Revitalised Ltd – Detailed Terms and Conditions
Introduction
This document outlines the terms and conditions governing the relationship between Revitalised Ltd, a registered company in the UK and Wales, and its clients (fitness establishments) and candidates (fitness professionals). By engaging with our services, all parties involved agree to abide by these terms.
Clients/Fitness Establishments
1. Recruitment Services
Revitalised Ltd operates as a fitness recruitment agency, specializing in hiring for short-term and long-term placements within fitness establishments.
2. Platform Usage
Clients can utilize our platform to submit job requests, following which Revitalised will promptly make the job live for potential candidates.
3. Access to Candidate Information
Clients will have access to candidate information only when required, such as prospecting for new jobs or arranging temporary cover. This includes qualifications and insurance certifications mandated by governing bodies and UK legislation.
4. Temporary Desk Usage
Clients utilizing the temporary desk agree to pay Revitalised a fixed margin on top of the class or day rate, ensuring fair compensation for fitness professionals. Invoices will include the margin and an additional 20% VAT.
5. Permanent Placements
Identifying a suitable fitness professional for permanent placement incurs a fixed resourcing fee. Engaging a candidate directly without paying this fee results in invoicing.
6. Posting Roles
Clients are expected to use the platform for posting roles in temporary, contract, and permanent positions. Details such as date, time, compensation, role responsibility, or class cover must be provided, and all fees are VAT added.
7. Unsuitability and Cancellation
Clients must promptly inform Revitalised of unsuitability decisions. Feedback for early termination must hold merit. A 24-hour cancellation policy applies to non-same-day bookings.
8. Invoicing and Payment
Upon candidate confirmation and completion, clients will be invoiced and must settle the payment within two weeks. Invoices include all applicable fees.
9. Notification of Long-Term Contract Changes
Clients must notify Revitalised at least 24 hours in advance of any occasions when a fitness professional under long-term contract will not be needed, avoiding invoicing.
10. Attendance Policy
If a fitness professional attends a booking not canceled under the agreed terms and is no longer needed, clients will be invoiced for the full rate with Revitalised's margin and VAT to ensure fair compensation.
11. Invoicing and Payment Process
Invoices are generated by Revitalised and payment is made directly to fitness professionals on the 15th of each month.
12. GDPR Compliance
All operations are in accordance with GDPR UK regulations.
13. Disclaimer
Revitalised does not take responsibility for any losses incurred through placements or breaches of terms and conditions.
14. Legal Actions and Complaints
Clients must inform Revitalised of any legal actions against fitness professionals within 14 days and can email info@revitalised.org with any concerns or complaints.
Fitness Professionals/Candidates
1. Qualifications and Compliance
Fitness professionals must be fully qualified in their respective disciplines and must upload all relevant qualifications, insurance, and compliance documents.
2. Code of Conduct
Fitness professionals must adhere to a code of conduct and will be removed from the platform for consistent negative feedback, lateness, or safety issues.
3. Professional Conduct with Clients
Candidates must not engage with customers or members of fitness establishments for the purpose of soliciting their own services.
4. Legal Responsibilities
Fitness professionals must comply with all applicable UK laws, including tax regulations.
5. Engagement Process
All details provided to Revitalised must be accurate and up-to-date. Candidates must be able to work legally in the UK.
6. Platform Usage
Revitalised reserves the right to remove any fitness professional from the platform if they fail to comply with terms and conditions.
